2. TERMS & CONDITIONS OF A SALE

These are the term under which a buyer will place an order

You acknowledge and agree that:

• None of the products displayed on our website are owned or manufactured by us but by 3^rd party manufacturers, their distributors or suppliers. Therefore, ensure that you have read & understood the manufacturer’s warranty & terms of use.
• Product images published on the site are for illustration & are provided by the manufacturer, the appearances, colors, texture, content, visuals etc may slightly vary from the actual product, however, we guarantee our customers that we will try & provide accurate information relating to all our products & services.
• You’ll pay the product price including applicable taxes (where applicable).
• You’ll pay ONLY through official provided channels at the check-out or at the branch before collection of a product. We DO NOT collect any payments using our service providers e.g shipping providers. We will not be responsible for any loss incurred as a result of payments made through unofficial channels.
• We have partnered with several logistics companies for FAST delivery of products in Kenya at competitive fees.

3. DELIVERY AND SHIPPING POLICY

We have partnered with several logistics companies for FAST & express delivery of products all over Kenya. We do home deliveries to your door step in Nairobi Metropolis & to pick up locations for outside Nairobi.

Delivery Timelines

Delivery timelines is the time taken between payment for a product & processing at the warehouse or branch until the product is delivered by courier service to a buyer’s pick-up location, store or home. These timelines will always vary depending on several factors including; delivery partner, distance etc.

Before placing an order, please note that;

• We DO NOT do Deliveries on weekends and public Holidays
• Nairobi Home deliveries will be done on SAME DAY & ATLEAST 2-3 hours after order confirmation. The buyer will cater for delivery charges depending on their choice of delivery.
• Pick-up Locations- All pick-up deliveries will be done on the next day delivery if an order is confirmed by 3PM & Within 48hours for orders placed after 3PM.

DELIVERY CHARGES & PICK UP LOCATIONS

• Where delivery is required, the buyer will carter for deliver, packaging, shipping, insurance & other costs. This payment will only be payable by the buyer as stated in product listings/checkout.
• The customer will cater for delivery costs for pick up locations (where Fonexpress doesn’t have presence) or should the buyer choose to use a shipping service partner for express deliveries and home deliveries

FAILED DELIVERIES, FOLLOW-UPS & ORDER TRACKING

Our dedicated team is always standing by to ensure that your delivery is done within the shortest time possible. Where delivery is not done within the stipulated timelines, please contact us to fast track it.

4. RETURNS & REFUNDS

• Always Inspect the product as soon as you receive it & check if it’s the right one. CONTACT US immediately incase you get a wrong delivery or for in transit damages.
• Returns of products by buyers and acceptance of returned products shall be at our discretion & guided by these terms and conditions.
• Returned products shall be accepted and refunds issued by Fonexpress, for and on behalf of the seller.
• Changes to our returns & refunds policy may change from time to time without notice & are effective in respect of all purchases made from the date of publication of the change on our website.

Eligibility

Requests to return will be accepted because of any of these reasons;

1. Wrong delivery
2. Shipping or Damaged in-transit damage

• Warranty returns and repairs- Returns of products covered by a valid warranty will be allowed. Refer to Warranty & Service Centre returns (LINK)

1. Upgrade- We accept return for product upgrades 48 hours after delivery or purchase.
2. Trade-ins -We accept trade-in based on a depreciated monetary value according to current market or as may be defined by the manufacturer trade-in terms.

• We do not accept return of the following products or because of the below reasons;
  • Damaged after deliver
  • Don’t want/like the product- Change of mind
  • Returns for accessories unless it’s rejected spot on-immediately after receiving it.

RETURN PROCESS

Where a product meets the return eligibility as outlined in our terms and conditions, below are the terms and the procedure that the buyer should follow or adhere to;

Always remember to include your order number, product purchased, date received, location and description of the damage or defect.

1. Ensure that the packaging is clean and in good condition- as was at the time of delivery. All freebies and accessories MUST be returned together with products being returned.

• After we receive the product being returned, we will do quality check & evaluation, we will provide an update using the contact details you will provide.

1. Where a return is rejected, we will call you and explain why; you will be required to collect the product from the branch or drop-off location. We will not be responsible for loss of products that have not been collected within 7-14 working days
2. Phones, tablets, televisions and some selected products we sell are covered by warranty of up to 24 months/ 2 years. The warranty protects you against manufacturer related defects which may not include accidental damages, wear and tear, unauthorized repair or attempt to modify, replace a part or component of the product.

REFUNDS

Where buyers have met the refunds eligibility terms defined on this policy.

• Refunds in respect of returned products shall be managed in accordance with the refunds policy and as we may determine from time to time.
• Refunds will be done in respect of product price paid by the buyer.
• We do not do refunds on charges incurred for shipping or payment transfers
• Refunds will be made by store credits, e-commerce coupon, mobile money transfer, bank transfers or as we may determine.

5. USE OF THE SITE

A buyer may do the following while on the site:

• Visit or view our site pages from a web browser.
• Purchase products from the site.
• Download pages from our website for caching in a web browser
• Play or view or stream media eg udio & video files on a media player on the site
• Unless you own or control the relevant rights in the material or it’s expressly permitted by these or other provisions of the terms and conditions you MUST NOT:
  • Download any images, videos, visuals, media, content or any other publications on the site.
  • Republish material from our website (including republication on another website);
